Who we are
Next Wave Business Services (“Next Wave,” “we,” “us,” or “our”) is an independent advisory firm that connects employers with payroll, human resources, employee benefits, and workforce solution providers.
This Privacy Policy describes NextWave's practices regarding information collected through nextwavebusinessservices.com (the “Site”).
We may update this Policy. The effective date above reflects the most recent revision. If we make a material change that requires additional notice or consent under applicable law, we will provide that notice or obtain that consent as required.
This Policy governs only the Site and NextWave's own handling of information. It does not govern the practices of providers, carriers, or other third parties whose sites you may visit.
Information we collect
Information you give us. When you complete a form on the Site, we collect the information you enter. Our intake form asks for your company name, your name, work email address, telephone number, number of employees, the states in which you operate, the service areas you are interested in, and a free-text description of what prompted your inquiry..
Information collected automatically. When you visit the Site we may collect technical information including IP address, browser type, operating system, referring page, pages visited, and time spent. This may involve cookies and similar technologies — see “Cookies and tracking technologies” below.
Information we do not collect. We do not request or knowingly collect employee health information through the Site, and our forms are not designed to receive it. Please do not submit medical records, claims information, benefit enrollment data, census files, policy documents, or invoices through any form on this Site. If documentation is needed during an engagement, your advisor will arrange for it to be provided through a secure channel outside this Site. If health information is submitted inadvertently, we will take reasonable steps to remove it from our active systems and handle it in accordance with applicable law.
Why we collect it, and how long we keep it
We collect information in order to respond to your inquiry and arrange a discovery conversation; understand your business well enough to identify appropriate providers; communicate with you about your inquiry and any resulting engagement; meet our legal, regulatory, and recordkeeping obligations; and maintain and improve the Site.We collect information in order to:

We retain personal information for no longer than necessary. In determining how long that is, we consider how long the information remains relevant, our legal and contractual obligations, applicable limitation periods, and any retention period required by law or recommended by a regulator or professional body. Inquiries that do not become engagements are reviewed periodically and removed when they are no longer needed.
Cookies and tracking technologies
The Site uses cookies and similar technologies to operate correctly, remember your preferences, and understand how the Site is used. Cookies are small files stored on your device by your browser.

Do Not Track. Browsers may transmit “Do Not Track” signals. Because there is no common industry standard for interpreting them, the Site does not currently respond to Do Not Track signals separately from the universal opt-out preference described above.
Text messaging (SMS)
Consent is optional. The Site includes an optional, unchecked checkbox allowing you to consent to receive text messages about your inquiry. Consent to receive text messages is not a condition of any purchase and is never required in order to use the Site or work with NextWave.
What we send. If you opt in, we may send you text messages relating to your inquiry, including acknowledgements, scheduling, and follow-up about your discovery conversation. Message frequency varies. Message and data rates may apply.
How to stop. Reply STOP to any message to opt out at any time. Reply HELP for assistance, or contact us using the details at the end of this Policy.
Mobile information is not shared for marketing. No mobile information collected through this Site, and no consent to receive text messages, will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers may be disclosed only to the service providers that operate our messaging platform on our behalf, and only to the extent needed to deliver the messages you have consented to receive. Those providers are prohibited from using the information for marketing or promotional purposes.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Who we share information with
We do not sell, rent, or lease your personal information. We do not maintain customer lists for sale to third parties.
Providers. Submitting a form on this Site does not send your information to any payroll, HR, benefits, or workforce provider. We share your information with a provider only after you have decided to move forward and have asked us to do so.
Our affiliate. Insurance services, including workers' compensation and employee benefits, are offered through our affiliate, Tobin Insurance, a licensed independent insurance agency. If your inquiry concerns insurance or employee benefits, we will share information with Tobin Insurance only after you decide to move forward and authorize us to make that connection. Tobin Insurance handles information it receives under its own privacy practices.
How we are paid. NextWave is compensated by the providers we place clients with. That compensation does not change what information we share or when — information reaches a provider only when you ask us to make the connection.
Service providers. We use third parties to operate the Site, host data, deliver email and text messages, and manage our customer records. They may process personal information only as permitted by our agreements with them and applicable law, in connection with the services they provide to us.
Legal and protective disclosures. We may disclose information where required by law, subpoena, court order, or governmental request; to enforce our Terms of Service; to outside auditors bound by confidentiality; or where reasonably necessary to protect the rights, property, or safety of NextWave, our clients, or the public.
Business transfers. If NextWave is involved in a merger, acquisition, or sale of all or part of its business, personal information may be transferred as part of that transaction. We will take reasonable steps to ensure it remains subject to protections consistent with this Policy.
Aggregated information. We may use and share information in aggregate or de-identified form that cannot reasonably be used to identify you.
Your choices
You may decline to provide information, though we may then be unable to assist you.
You may opt out of marketing emails at any time using the unsubscribe link in any message, or by contacting us. You may opt out of text messages by replying STOP. We may still contact you for non-marketing reasons relating to an active engagement, a security matter, or a change to our terms.
Your privacy rights
Depending on where you live, applicable state law may give you some or all of the following rights regarding personal information we hold about you:

We may take reasonable steps to verify your identity before completing a request, and we may ask for information sufficient to confirm that you are the person the information relates to. An authorized agent may make a request on your behalf where applicable law allows; we may ask for proof of that authorization.
Timing. We will respond within the period required by applicable law, and will tell you if we need additional time.
Appeals. If we decline your request, we will tell you why. Where applicable law gives you a right to appeal that decision, our response will explain how to appeal and how long we have to respond. If an appeal is denied, you may contact your state attorney general.
Security
We use reasonable administrative, technical, and organizational safeguards designed to protect the information we hold.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a security incident requires notification under applicable law, we will provide the required notices in accordance with that law.
Children
The Site is directed to businesses and is not intended for children. We do not knowingly collect personal information from anyone under the age of thirteen. If we learn that we have done so, we will delete it. If you believe a child has provided us with personal information, please contact us using the details below.

The Site contains links to other websites, including those of our affiliate and of providers. We are not responsible for the privacy practices of those sites. This Policy applies only to information collected by NextWave through this Site. We encourage you to read the privacy policy of any website you use.
Users outside the United States
NextWave operates in the United States. If you provide information to us from outside the United States, your information may be transferred to and processed in the United States and other locations where our service providers operate, subject to the practices described in this Policy.
